By using this site (thinkandact.ie) you agree to be bound by the terms and conditions (“Terms of Use”) set out hereunder and by the Think and Act Website Privacy Policy and any other Policies which may from time to time be published on this site (“Related Policies”) and which form an integral part of these Terms of Use.

Think and Act reserves the right to change these Terms of Use and Related Policies from time to time. Modification of these Terms of Use or of any of the Related Policies shall constitute adequate notice of any changes made save where expressly provided otherwise and only to the extent so provided hereunder or in any of the Related Policies.

You agree to use thinkandact.ie only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit the use or enjoyment of this website by any third party. Prohibited behaviour includes but is not limited to infringement of third party intellectual property and other rights, defamation, harassing or causing distress or inconvenience to any person, soliciting minors, transmitting obscene or offensive content or anything which may affect the operability of these Terms of Use and/or Related Policies.

Think and Act will not be liable for any loss or damages howsoever arising from or in connection with the use or the inability to use thinkandact.ie.
If any provisions of these Terms of Use and Related Policies are found to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms of Use and Related Policies are intended to be effective, then to the extent and within the jurisdiction in which that provision is illegal, invalid or unenforceable, it shall be severed and deleted from these Terms of Use and /or Related Policies and the remaining provisions shall survive and remain in full force and effect.

These Terms of Use and Related Policies and all disputes and matters arising out of or in connection with them shall be governed by and interpreted in accordance with the laws of Ireland and subject to the exclusive jurisdiction of the Irish Courts.

Copyright and Intellectual Property

The content on thinkandact.ie is governed by the Creative Commons system of licensing. Use of content on the site is permitted provided: copyright ownership and authorship of the content is attributed; it is not used in any way, directly or indirectly, for financial reward or other remuneration or commercial purposes; it is not repurposed or reversioned without the written permission of the copyright holder; and that any use or re-use of the content is subject also to these conditions.

However, in using this site or accessing any of the content on this site you acknowledge that each of Pivotal Arts, Educate Together, the Think and Act project and the content on thinkandact.ie including but not limited to text, images and logos identifying Pivotal Arts, Educate Together, the Think and Act project and thinkandact.ie or third parties and/or their products and services are subject to copyright and/or other intellectual property rights owned by Pivotal Arts or Educate Together and/or third parties. You are not permitted to use any copyright or any other intellectual property right of Pivotal Arts or Educate Together and/or any other third party without the prior written consent of the relevant intellectual property right holder save as already provided for in these Terms of Use.

User Generated and User Posted Content

By posting user generated and/or user posted content (“User Content”) on thinkandact.ie (which for the purposes of these terms and conditions is defined to include any media of whatever nature including without limitation any text, comments or submissions, photographs, graphics, video or audio posted by you to thinkandact.ie, you agree that Educate Together and / or Pivotal Arts may – free of charge – use, edit, move, moderate, copy, disclose to third parties and make the User Content or any part of it available as it sees fit on the thinkandact.ie website or third-party services in any media worldwide now known or later developed. By providing User Content to thinkandact.ie you confirm and warrant that it is your own original work and not copied from anyone else or infringing any third party’s intellectual property or other rights and is not defamatory, obscene, harmful to minors, harassing, offensive, sexist, homophobic, threatening, encouraging racial hatred or violence or in breach of anyone’s privacy, or confidentiality rights or prejudicial to legal proceedings and is not posted for promotional or commercial purposes. Neither Educate Together nor Pivotal Arts guarantees to use or otherwise make available User Content.

You agree to fully and effectively indemnify and hold harmless Educate Together and Pivotal Arts in respect of all damages, claims, demands, liabilities (including liability to third parties), losses, costs and expenses (including reasonable legal fees and costs) arising out of, in connection with or as a result of a breach of the warranty in connection with User Content given by you in these Terms of Use.

Where User Content is provided by you by way of comments that are posted to any part of thinkandact.ie you agree that you will not seek to impersonate a third party or post comments which are falsely attributed to any third party. You acknowledge that you are responsible for any comments posted by you and that you are solely responsible for your conduct in posting such User Content to any part of thinkandact.ie. You must not include any links to any website or webpages.

By posting User Content on thinkandact.ie you confirm that you have the right to give Educate Together and Pivotal Arts permission to use it for the purposes specified above, and that you have the consent of anyone who is identifiable in your User Content or the consent of their parent/guardian if they are under-18. Thinkandact.ie will show your display name with your User Content. Educate Together or Pivotal Arts may need to contact you for administrative or verification purposes in relation to your User Content. Educate Together and Pivotal Arts processes information about thinkandact.ie users in accordance with the Think and Act Website Privacy Policy. Work or content displayed on thinkandact.ie and User Content does not, unless specifically stated, represent the views of Educate Together or Pivotal Arts or thinkandact.ie.

Educate Together and / or Pivotal Arts reserve the absolute right to edit, move, cease to publish, moderate and delete User Content in its absolute discretion. Neither Educate Together nor Pivotal Arts can publish comments which are not accompanied by a display name and email address.
